Construction Company pays Fired Employee

A Lusaka based construction company has paid a man whom it dismissed last
year after Legal Resources Foundation (LRF) intervened.
The man Daniel Mwanza said the Company's director dismissed him on grounds
of being a danger to the Company and it's operations due to his behavior.
Mwanza said he had worked for the company since March 2000 and was dismissed
in November 2003.
He said he decided to report the matter to LRF's Kaunda Square office
because he was not satisfied with the explanation of his dismissal, as he
was not given any chance to be heard.
Kaunda Square paralegal Felix Kaoma said he called the director for Lind
Construction and Engineering Company to the office for mediation and he
accepted to pay him his dues.
Kaoma said there even if Mwanza's conduct was bad, the director was wrong to
dismiss him.
According to Section 268 Cap 28A which states that no one's employment
should be terminated without being given a chance to be heard.
He said basing on these arguments, the director agreed to pay him K3.150m
after admitting to wrongful dismissal.
Mwanza praised LRF for the assistance rendered to him.
