Four Murder Suspects Walk to Freedom

THE Ndola High Court has discontinued the writ of Habeas Corpus for four
Nakonde men who were being detained for murder after the state entered a
nolle prosequi.
Legal Resources Chambers Lawyer Suzyo Ndovi made an application for Habeas
Corpus for Clifford Mukwasa, Flemmington Mukwasa, Richard Sinkala and Happy
Siame for which Ndola High Court Judge Wanki granted leave on November 16
2006.
The matter which was coming up for inter-party hearing on February 16 2007
was however discontinued because the state in its affidavit in opposition
stated that they had entered a nolle prosequi.
In the Habeas Corpus application the four has stated that they were arrested
on March 3, 2006 by Community Criminal Prevention Unit (CCPU) officers and
three police officers from Nakonde Police Station on allegations of murder.
They said they were detained at Isoka State Prison and they appeared on May
23 2006 before Magistrate Nampunge of Nakonde Magistrate Court who adjourned
the matter sine die until other suspects were arrested.
The four said their continued detention without trial was unlawful and they
were seeking the court's indulgence to grant them leave to issue write of
Habeas Corpus.
Particulars of the case are that the four were arrested in connection with
the murder of Suwilayi Nachizya on March 8 2006 while they were working in
the field.
The four walled to freedom and thanked LRC for their assistance.
